These Terms of Service (“Terms”) govern your use of the My Gem School mobile application and related website (collectively, the “Service”), operated by Terminus Foundation LLC, a California limited liability company doing business as My Gem School (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
Please read the Dispute resolution & arbitration section carefully. It requires most disputes to be resolved by binding individual arbitration rather than in court, and waives your right to participate in a class action. You may opt out within 30 days.
Eligibility
The Service is for parents, guardians, and other adults researching schools for children. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
Subscriptions & in-app purchases
The Service may offer paid features through Apple’s App Store, including:
- Gem+ subscriptions (monthly or annual) — auto-renewing subscriptions billed to your Apple ID. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel in your Apple ID / App Store subscription settings.
- Season pass — a non-renewing 90-day pass that grants premium access for 90 days from purchase and does not auto-renew.
- Single-report unlocks — consumable purchases that permanently unlock one school’s deep-research report for your account.
Prices are displayed in the app at the time of purchase. Payment is charged to your Apple ID account at confirmation. Refunds are handled by Apple under Apple’s refund policies; contact Apple Support or request a refund through reportaproblem.apple.com.
Unused portions of a subscription period generally are not refundable when you cancel mid-period, except where required by law or granted by Apple.
AI-generated content
School matches, research reports, assessments, and other outputs are generated with artificial intelligence and third-party data sources. They are for informational purposes only and are not professional educational, legal, or admissions advice. Always verify important details (deadlines, requirements, tuition) directly with schools before making decisions.
We are not affiliated with, endorsed by, or sponsored by any school, district, or educational institution listed in the Service. School names are used for identification and descriptive purposes only.
Information about schools & how to request a correction
If you are a school administrator, staff member, or representative and believe information about your school is inaccurate, outdated, or incomplete, please contact us at support@mygemschool.com. We take corrections seriously and will review every request.
Information about schools in the Service comes from a combination of:
- Public federal data, primarily the National Center for Education Statistics (NCES) Common Core of Data and Private School Universe Survey;
- Third-party enrichment such as Google Places (photos, ratings, contact details, hours);
- Publicly available information on the web, including school websites; and
- AI-generated summaries and research reports derived from the above.
Because federal survey data is collected on a multi-year cycle and AI-generated content is produced from sources available at the time of generation, some details may lag reality or be incorrect.
To help us resolve a request quickly, please include:
- The school's full name, city, and state (and NCES ID if you know it);
- The specific information you believe is inaccurate, and where it appears;
- The correct information; and
- A source we can verify, such as a link to the relevant page on the school's official website.
We aim to acknowledge correction requests within five business days. Where a correction is verified, we will update the underlying record and regenerate any affected cached AI content. We may decline requests that ask us to remove accurate public-record information or to alter genuine parent sentiment, and we do not accept payment in exchange for changing, improving, or removing a school's information or ranking.
App users can also flag a problem from within the app on any school's detail screen, which routes to the same review process.
Your responsibilities
- Provide accurate information where requested.
- Use the Service lawfully and do not attempt to disrupt, scrape, or reverse-engineer it.
- Do not misuse AI features to generate harmful, fraudulent, or spam content.
- Keep your account credentials secure.
Account termination
You may delete your account at any time from Settings in the app. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons. Deleting your account does not automatically cancel an active Apple subscription — cancel that separately in App Store settings.
Intellectual property
The Service, including its design, branding, and software, is owned by Terminus Foundation LLC and its licensors. You receive a limited, non-exclusive license to use the app for personal, non-commercial school research.
Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TERMINUS FOUNDATION LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
Governing law & dispute resolution
Governing law
These Terms, and any dispute arising out of or relating to them or to the Service, are governed by the laws of the State of California, without regard to its conflict-of-laws rules. This choice of law does not deprive you of the protection of any mandatory consumer-protection rules of the place where you live.
Talk to us first
Most concerns can be resolved quickly. Before starting a formal proceeding, you agree to contact us at support@mygemschool.com with a short description of the issue and the resolution you are seeking, and to give us 30 days to resolve it informally. We will do the same before bringing a claim against you.
Binding individual arbitration
If we cannot resolve a dispute informally, you and Terminus Foundation LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitrator's award may be entered as a judgment in any court with jurisdiction.
Arbitration will be conducted by videoconference or through written submissions where the rules allow. If an in-person hearing is required, it will take place in the county where you live or another location we both agree on. The AAA's rules govern the allocation of arbitration fees; where those rules require a consumer filing fee that exceeds the cost of filing in court, we will pay the difference.
Exceptions
Arbitration is not required for:
- Individual claims brought in small claims court, so long as they remain individual claims; or
- Requests for injunctive or other equitable relief in court to stop infringement or misuse of intellectual property.
No class actions
You and we agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding, and the arbitrator may not consolidate claims or preside over any form of representative action. If this paragraph is found unenforceable as to a particular claim or request for relief, that claim or request will be severed and heard in court, while the remaining claims proceed in arbitration.
Your right to opt out of arbitration
You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing support@mygemschool.com with the subject line “Arbitration Opt-Out” and including your name and the email address on your account. Opting out affects only this section; the rest of these Terms continue to apply, and opting out will not affect your use of the Service in any way.
Court proceedings
For any dispute that is not subject to arbitration, you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Santa Clara County, California, from which the Service is operated. This does not affect your right to bring an individual claim in small claims court in your own county, or any right you may have under applicable law to bring a claim where you live.
General
- Severability: If any provision of these Terms is found unenforceable, the rest remains in effect.
- No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service.
- Apple: Apple is not a party to these Terms and is not responsible for the Service. Apple's own terms apply to purchases made through the App Store.
Changes
We may update these Terms from time to time. Continued use after changes constitutes acceptance of the revised Terms.
